The Occupational Safety and Health Administration, or OSHA, plays a significant role in virtually all businesses?regardless of size. However, a small business receiving a notice that OSHA is coming to audit, or in a worst-case scenario-there is a serious accident or fatality at the place of business or job site, can spell doom due to significant fines including shutting the company down altogether. The published mission of OSHA is, ?to assure the safety and health of American workers by setting and enforcing standards; providing training, outreach and education; establishing partnerships; and, encouraging continual improvement in workplace safety and health.?

In reality, a small business is a family within a family. Therefore, a serious injury, illness or worse case scenario?a fatality?is not just a statistic that is read in the newspaper, but a major crisis on many levels for you and your employees. The business loses an employee, but the family loses a loved one and income when the employee becomes disabled and unable to work. In most cases, the employee is the sole or significant breadwinner and their disability or loss results in disastrous financial implications for the family. When businesses operate under a comprehensive safety and health program, incidents of injury and illness go down, insurance costs go down and worker compensation payments go down. The resulting increase in employee moral, productivity and company competitiveness translates into increased profits.

OSHA has developed a variety of tools (and in multiple languages) from partnership, consultation, compliance assistance, education and training and outreach, as well as plain language regulations to help the small business community not only comply with regulations, but assist in the development of programs that benefit the employee as well as the employer. It is unfortunate that many small business owners are afraid to take advantage of these tools because they mistakenly believe that if they contact OSHA for help, it will trigger an inspection. OSHA has a long-established policy that information inquiries received by the agency regarding safety and health regulations or other subjects, shall not trigger an inspection. OSHA?s Non-Retaliation Policy reads as follows, ?Contacts for information initiated by employers or their representatives shall not trigger an inspection, nor shall such employer inquiries protect them against regular inspections conducted pursuant to guidelines established by the agency??

One very valuable program is OSHA?s Free On-Site Consultation designed to help small business employers provide a safe workplace for their employees. The program offers technical assistance to employers on hazard identification and correction, as well as demonstrates to employers how to maintain an effective safety and health management system. Assessments can encompass the entire operation or specific areas that the employer identifies. Some of the consultation process can include appraisal of all mechanical and environmental hazards, work practices, appraisal of the present job safety and health program (or the establishment of one), a written and verbal report as to the findings and agreements of the appraisal as well as training and assistance with implementation recommendations.

OSHA?s Safety and Health Achievement Recognition Program (SHARP) recognizes small business employers that provide an exemplary safety and health management system at the place of business or worksites. When a business qualifies for the SHARP program they are exempt from programmed OSHA inspections during the time their SHARP certification is in effect. According to OSHA?s web site, to participate in SHARP, a business must:

  • Request a consultation visit that involves a complete hazard identification survey;
  • Involve employees in the consultation process;
  • Correct all hazards identified by the consultant;
  • Implement and maintain a safety and health management system that, at a minimum, addresses OSHA?s 1989 Safety and Health Program Management Guidelines;
  • Lower the company?s Lost-Workday Injury and Illness rate (LWDII) and Total Recordable Case Rate (TRCR) below the national average; and
  • Agree to notify the state Consultation Project Office prior to making any changes in the working conditions or introducing new hazards into the workplace.
  • After a business satisfies all SHARP requirements, the Consultation Project Manager in the business? state may recommend the worksite for final SHARP approval and certification. The state and OSHA will formally recognize the business or worksite at a SHARP awards ceremony.

If a business meets most, but not all, of the SHARP eligibility criteria and are committed to working toward full SHARP approval, the business may be recommended for an inspection deferral of up to 18 months if:

  • The business has had a complete hazard identification consultation visit at your worksite and you have corrected all hazards;
  • The business is in the process of implementing an effective safety and health management system; and
  • The business can meet all SHARP requirements during the deferral period.

As compliance assistance and specialists, OSHA maintains a website with compliance materials available to the small business owner. The site is found at www.osha.gov. This site also allows computer training based software, which addresses items such as hazard communication, asbestos, cadmium, confined spaces, fire safety and lead in construction. There are compliance specialists that respond to the needs of the small business community and coordinate various programs. These programs include seminars and workshops, developing and promotion cooperative programs with industry groups and the SBA, and coordinate OSHA?s training resources. These training opportunities can be industry specific through trade and industry groups, or there are several regional training and education centers across the country that provide basic and advanced courses in safety and health.

As another benefit to small business, OSHA has reduced recordkeeping requirements for small businesses with fewer than 10 employees. Did you know that as a small business you are exempt from most OSHA recordkeeping requirements for recording and reporting occupational injuries and illnesses? Did you also know that OSHA provides for penalty reductions for small businesses? A 60% penalty reduction may be applied if an employer has 25 or fewer employees, a 40% reduction if the company has 26-100 employees and a 20% reduction if the employer has 101-250 employees. Is your company missing out by not embracing the opportunities available?

As a business owner, if you are not taking advantage of the Occupational Safety and Health Administration?s support and vast programs specifically designed to assist the business community, you very well may just pull out your wallet and pay your share of that one billion dollars per week in hard costs. Do not forget about the other costs? beyond money?in the form of lost productivity, the bruised morale of your workers and the untold personal cost of having an employee seriously injured or killed with their family financially ruined. With just a little forethought, many of these can be minimized or avoided altogether.

On a final note, every safety and health program should be tailor made to fit each individual business by blending into its unique operations and culture. The best way to maintain a balance between management and employees is to keep everyone involved. A business owner can maintain a system that continually addresses workplace hazards and involve all employees in policymaking on safety and health issues on a regular basis. The business owner should then post the company?s written safety and health policy in a conspicuous place for all to see.

Cables From Kabul - The Inside Story of the West's Afghanistan Campaign

Sir Sherard Cowper-Coles, Harper Press, 2011

Joining the ever expanding series of memoirs from former officials involved in the Afghan and Iraqi wars, Sherard Cowper-Coles' book attempts to "illuminate some of the political and diplomatic aspects" of the war in Afghanistan. As British ambassador in Kabul between 2007-2010, in what he described as "the best and the worst of diplomatic postings," Cowper-Coles has written an immensely readable and insightful account of what appears to be a structurally flawed expedition.

Cowper-Coles describes his position at the Embassy as being "the headmaster of a rundown but generally happy and successful prep school." The book is full of diplomatic gems such as the naming of the Embassy bar as the 'Inn Fidel' and the excitement of a beard growing competition. Cowper-Coles comes across as a likeable narrator throughout and any potential disgruntlement with an institution that ultimately failed to match his ambitions is largely hidden. The former ambassador is fulsome in his praise for those he worked with, but is critical of the structure of the British presence in the country, with the rapid cycling of tour rotation leading to an 'addiction to high allowances' which created a 'post-conflict stabilisation industry.' The problem was more pronounced for the military where the "six-month rotation system risked the British Army in Helmand continually reinventing the wheel." What is more, upon arrival each brigadier would do what 'soldiers expect to do' and launch a major kinetic operation, regardless of the subtleties of counterinsurgency theory.

The book is critical of the often dysfunctional relationship between the military and politicians. In the United Kingdom, the government was "subject to continual pressure from the British military" to send more troops and resources to Afghanistan, and according to the author the Ministry of Defence "fell short of the standards for clear and objective advice" to the political leadership. They were particularly guilty of regularly giving overly optimistic advice that can be surmised as "progress is being made but challenges remain." That they were allowed to get away with this is due to a combination of politicians' ignorance, as "only a minority of politicians have any real military knowledge or experience," combined with their fear of being labelled unpatriotic by the right wing press. Cowper-Coles's description of the problem is succinct, his preference for "optimism founded in realism' is a stark contrast to what he sees as the military's 'optimism found in unrealism," characterised by General Richard's description of 'astronomical' progress being made. Despite these criticisms Cowper-Coles was obviously impressed by the military, admitting that 'every helicopter ride was a thrill' and that 'it was fun, dressing up in desert camouflage, donning helmets and body armour, and leaping in and out of helicopters and armoured personnel carriers'.

Throughout the book some of Cowper-Coles most fascinating insights are a reflection not on Afghanistan, but rather his American allies. He wonders "whether the US was fit for the quasi-imperial purpose it had assumed?" and attending a conference in the US describes the "sense of a great leviathan rolling forward, spending money, establishing programmes, without knowing what everything was for." Yet Cowper-Coles is clearly conscious that the only way to make a difference was to work with the Americans, as it was an "illusion" that Britain could have "an independent strategy" and "all of us knew that the real decisions were taken in Washington."

After being promoted to become the Foreign Secretary's Special Representative for Afghanistan and Pakistan, Cowper-Coles chronicles his attempts to influence the Americans which involved following Richard Holbrooke's 'flying circus' across the globe. Although the book is dedicated to Holbrooke, Obama's late Afghanistan point man comes across as a strange and distracted figure, who, despite being acknowledged as a intellectual heavyweight, flittered through meetings checking his blackberry or answering calls and often seemed more interested in fine dining than in really hearing Britain's arguments on what to do in Afghanistan. The circus of Special Representatives meetings is savaged for substituting "form for substance, discussion for delivery, activity for real achievement" while the attempts to persuade the Americans of a more political approach were 'ultimately fruitless'.

Cowper-Cole admits that he never "quite understood why Britain took it upon itself to act as principal cheerleader for the American-led effort" at "military colonialism" in Afghanistan. Despite how closely he worked alongside the Americans the difference in values is made clear, in one particular incident Karzai decided to execute some prisoners who were eventually gunned down whilst fleeing, the US ambassador describing the killings as "a beacon of hope for the future of Afghanistan." Engagement and access to President Karzai is another central theme of the book and while we learn that the Afghan leader loves trains and effervescent vitamin tablets, ultimately Cower-Coles admits that he's not the right man for the job as he is a 'flawed product' lacking the necessary skills of needed to run the country.

The former ambassador argues that what is needed in Afghanistan is a focus on political solutions, backed by the military, and a regional scope that brings the multitude of international actors into a big tent. Sound byte friendly slogans such as "Clear, Hold and Build" are dismissed as not 'really a strategy' but rather 'little more than a tactic'. You'd think that Cowper-Coles would be pleased by Prime Minister David Cameron's words given in Afghanistan in July, when he urged the Taliban to "stop fighting, put down your weapons and join the political process". However Cowper-Coles thinks that the West today "are not serious abut solving Afghanistan, they're serious about getting out" and his book concludes by bemoaning an "enterprise [that] has proved to be a model of how not to go about such things." He finishes by updating one of Lawrence of Arabia's strategies that it is "better to let the Afghans themselves do a job badly than for us to do it for them."

Music Review: Tony Bennett - Tony Bennett: The Best Of The Improv ...

Tony Bennett is an American music icon and one of the last of a generation of singers who came to prominence during the years following World War II. He has sold in excess of 50 million albums, won 15 Grammy Awards, and his popularity now spans several generations of music fans.

He signed with the Columbia label in 1952, and it proved to be his musical home for over 20 years. The British Invasion and the commercial dominance of rock ended his relationship with Columbia as he was resisting their overtures to change his style. He resigned with Columbia in 1986 and remains with them to the present day.

After leaving Columbia, he released albums for several labels but quickly formed his own label, Improv Records, during the mid-1970s. His albums for the label were artistically successful and critically praised. They were not to be as commercially successful as his work with Columbia, which would lead to the dissolution of the label after several years.

Improv only released 10 albums during its existence, with half being by Bennett. They were an eclectic lot featuring two albums of songs by Rodgers and Hart, standards featuring the Ruby Braff-George Barnes Quartet, orchestral arrangements by his music director at the time, Torrie Zito, plus a brilliant jazz duet album with Bill Evans. His entire output for the label was issued in 2004 as a four CD box set titled The Complete Improv Recordings.

The Concord Music Group has now gathered 16 tracks from his time with the label and released Tony Bennett: The Best Of The Improv Recordings, which will be released in conjunction with his upcoming 85th birthday. While all the tracks were previously released on the box set, this single CD serves to give a nice taste of one of the most artistic periods of his career.

His material during the last several decades has many times gone in a light jazz direction. He recorded two duet albums with jazz pianist Bill Evans and four tracks are taken from the second, Together Again, which was issued by his own label. "Make Someone Happy," "You Don't Know What Love Is," "You Must Believe In Spring," and "Maybe September" are just Evans' piano and Bennett's voice and it doesn't get much better than that.

The rest of the album is standards that fit his style well. Songs such as "Isn't It Romantic," "Blue Moon," "As Time Goes By," and "The Lady Is A Tramp" all undergo a transformation courtesy of his unique interpretations. The final track was a live performance of his most famous song, "I Left My Heart In San Francisco." Recorded in May of 1977, it is a nice mid-career update of this eternal classic.

Tony Bennett: The Best Of The Improv Recordings is a fine sampling of an often lost period of his career. If you own the box set, this release in not needed, but as a stand-alone album, it resurrects some of the better material of his career that you may have missed.
